A-JU TOURS STANDARD TERMS AND CONDITIONS
By doing business with A-Ju Tours, Inc. (hereinafter TO), you hereby agree and consent to all of the following terms and conditions:
REFUNDS AND PENALTIES: We regret that no refund can be made for absences from a tour, including but not limited to, missed meals or sightseeing. TO makes no representations or guarantees concerning reimbursements of funds paid by you under any insurance claim. Please consult TO for its reimbursement policy on cancellation of tours prior to commencement of a tour.
RIGHT TO CHANGE PRICING, SCHEDULING AND ACCOMODATIONS: TO will lake all benefits and all losses of all fluctuations in price and value of airfares, cruise fares, currencies, park fees, hotels, taxes, or fuel surcharges after we have received full payment from you. As well we reserve the right to correct promotional or pricing errors or to increase the tour price in the event of cost increases due to changes in airfares, cruise fares, currency price fluctuations, park fee increases, taxes hotel prices, or fuel surcharges before we receive your reservation deposit. All prices, tariffs, itineraries, and schedules provided by TO are subject to change without notice. The TO reserves the right to cancel or reschedule any tour departures in accordance with operating requirements or circumstances beyond its control. In addition, TO reserves the right to change hotel accommodations before or during any of its tour programs. In the event of any hotel changes, the TO will provide, if possible, comparable or better hotel accommodations. If accommodations are of a lesser quality based on independent agency's rating of hotels, the TO will refund any difference in hotel tariff paid by TO for the substitute accommodations to the passenger after the completion of the tour. The price difference will not be the retail price difference, but the difference in wholesale price the TO receives as a large volume provider of travel services. Tour prices are based on wholesale costs, charges, tariffs, rates, prices, taxes, levies, and currency exchange rates. Should any of the costs change, a surcharge may be made on the price of your vacation. Due to contractual requirements, TO is not able to provide you with a breakdown of the cost for each individual component of your purchases if the total package charge has been charged as one amount.
RIGHT TO CHANGE TOUR DEPARTURE DATE: TO reserves the right to cancel or reschedule any tour departure. If cancellation is made prior to departure of the tour, the only responsibility of TO will be to refund to the passenger the amount TO received for the tour reservation. TO will try to re-book the same tour with a different departure date, or a similar tour. Where TO has confirmed flights, we will try to confirm air seats for the selected new dates, subject to availability. TO cannot assume responsibility for any additional costs or fees relating to the issuance and/or cancellation of air tickets or other travel arrangements not made through TO.
AIR TRAVEL: Any and all airline tickets purchased through TO serve as a contract between the airline and the passenger. TO cannot and shall not be held liable for any harm caused to customers by any of the airlines, moreover, you hereby agree not to hold TO liable for such damages. Please be sure to carefully check the international and domestic air tickets you purchase so that you are fully aware of the respective airlines' policies.
BAGGAGE/LOST OR STOLEN ITEMS: TO is not responsible for lost or stolen luggage or other items and you agree not to hold TO liable for such lost items. You are responsible for checking and complying with all airline and transportation requirements for your luggage. When on tour, please do not leave your possessions unattended at any time. Remember coats, umbrellas, cameras, handbags, wallets, traveling bags, binoculars, and similar items remain, at all times, under your custody and control.
TRAVEL DOCUMENTS: Each participant is responsible for obtaining required travel documents, such as Passports, Visas, etc. Please check with the destination country's local consulate if you have any questions. Government issued photo ID is required at airports and hotels and may be required by other travel suppliers.
MINORS: All persons under 18 years of age must be traveling with a parent or appointed guardian or must obtain signed permission of a responsible adult to travel alone. TO may refuse, in its sole discretion, to allow anyone under age 18 to travel without a parent or appointed guardian. TO is not responsible for conduct of minors in any manner whatsoever. In addition, due to heightened security, many countries have adopted practices to prevent international abduction of children. If a child will be traveling with adults other than the parents or with only one parent it is recommended that a notarized letter be written by the parents or non-travelling parent granting authorization to travel, including the dates of travel. We suggest you also contact the appropriate consulate and airlines because they may have additional requirements.
NOT INCLUDED IN COST/ADDITIONAL SERVICE CHARGE: Passport and visa fees and items of a personal nature, ie., room service, airline luggage fees, telephone calls, laundry, liquor and all items and services not indicated as included such as optional tours/activities are not included. Also, you will be required to pay a daily mandatory service charge (¡°MSC¡±) to a tour guide. However, MSC are the exclusive property of the TO. Please check with TO regarding your specific tour to determine what the daily MSC will be.
RESPONSIBILTY: TO may be acting as an intermediary and agent for suppliers in selling and booking travel services which are not directly supplied by this travel agency (such as air carriage, lodging accommodations, ground transportation, meals, tours, cruises, tour guide services. etc). TO, therefore, shall not be responsible for breach of contract or any intentional or careless actions, errors or omissions on part of such suppliers which result in any lags, damage, delay or injury to you or your travel companions or group members. TO shall not be responsible for any injuries, damage or losses caused to any travel in connection with weather, terrorist activities, social or labor unrest and mechanical or construction conditions or developments, or any other actions, errors, omissions or conditions outside the TO's control. By embarking upon such travel, you the traveler voluntarily agree to assume all risk. involved in such travel, whether expected or unexpected. The traveler is hereby warned of such risk and is advised to obtain appropriate insurance coverage against such risk. Your retention of tickets, reservations or bookings after issuance shall constitute consent to the above, and an agreement of our duty to convey the contents hereto to your travel companions or group members. The right is reserved to decline to accept or retain any person as a member of any tour as circumstances may demand it. Baggage is carried at the owner's risk and baggage insurance is recommended. The issuance and acceptance of any bookings with TO shall be deemed to be your consent to the above conditions.
TOUR GUIDES: Tour Guides may not be employees of TO but may be independent contractors. TO is not responsible for any unauthorized activities. TO takes the misconduct of tour guides very seriously and requests that you immediately inform TO of any complaints with respect to any tour guide.
CUSTOMER CONDUCT: For the benefit of everyone on your vacation TO reserves the right to accept or reject any person as a tour participant and to remove from the tour any participant whose conduct is deemed detrimental to the safety or reasonable enjoyment of the other participants on a particular tour.
HOLIDAYS: During international or national holidays, certain facilities such as museums and restaurants, sightseeing tours and activities, and shopping may be limited or not available. Alternatives will be offered wherever possible.
SPECIAL REQUIREMENTS: Passengers with disabilities are welcome on TO's tours provided that they are accompanied by a companion capable of providing all assistance required, and do not require special assistance from TO' s personnel and/or independent contractor tour guides. TO reserves the right to refuse to carry anyone it felt cannot cope with the requirements of lay travel who may require services and facilities that TO cannot guarantee will be available. You agree to NOT hold TO responsible for any decision made by TO, its employees or affiliates. In addition, You the traveler are responsible for (1) advising TO in writing in advance of any special requirements you may have and (2) advising your TO in writing in advance of medical conditions that may in any way affect your ability or the ability of any member of your traveling party to undertake the travel arrangements that you have purchased. In addition you must provide TO a letter from your personal physician stating the nature of the medical condition and certifying that you are physically fit to undertake the travel services as purchased. Without such written notice, TO accepts no responsibility for special requirements NOT provided. Some travel itineraries offered by TO may require you to undertake medical examinations. You may also be required to show these documents to certaim travel suppliers.
INSURANCE: Baggage, health, and trip cancellation insurance must be purchased by you through your own insurance agent and is strongly recommended.
DISPUTES: If you have a dispute with TO, you are encouraged to discuss it with TO in order to attempt to resolve it. TO is registered with the Travel Consumer Restitution Corporation (TCRC). In the event of a dispute with TO, you may have a right to a refund or other compensation from TCRC. A claim form is available from the Travel Consumer Restitution Corporation, PO Box 6001, Larksour, CA 94977 (telephone 415-461-9734) or TO can provide you with one.
HAZARDOUS CONDITIONS: TO has no special knowledge of and shall not be held liable for hazardous conditions at destinations, including, but not limited to, weather hazards, health hazards, unsafe conditions, suppliers bankruptcies or the suitability for disabled persons during any portion of the tour. For information regarding possible dangers at international destinations (outside of the U.S.) you may contact the Travel Advisory Section of the U.S. State Department (202)647-5225, or access the State Department's online travel advisory service at http://travelstate.gov/travel/warnignstarnl. For medical information, call the U.S. Centers for Disease Control, (404)332-4559 or on the web at www.cdc.gov/travel.
LIMITATIONS ON LIABILITY AND NOTICE OF CLAIMS: TO makes no representations or warranties other than those contained expressly in any agreement with you. Neither any advertising, circulars, other information nor statements you may receive shall constitute any such representation or warranty. There are no implied warranties or guarantees of any kind. Except where prohibited by law, TO's liability to you for any reason whatsoever, including personal injury, death, or other loss is strictly limited to the amount you paid for the tour. All disputes between customer and TO, which are not resolved directly with the TO or through TCRC, shall be resolved by mediation. Mediation fees, if any, shall be divided equally among the parties involved. If the attempt to resolve the dispute by mediation fails, then TO and Customer, you, agree to do binding arbitration before a single neutral arbitrator pursuant to the rules of ADR Services. Inc. in Los Angeles, California. Arbitration fees, shall be divided equally among the parties. Any award issued in such arbitration may be confirmed in any court of competent jurisdiction. In order that TO has an opportunity to accurately and fairly investigate any claim, except where prohibited by law, as a condition precedent to any arbitration or other action on any claim, you must give notice to TO in writing of such claim within thirty (30) days of any injury or loss or you waive such clam. Further, you must wait an additional thirty (30) days before demanding arbitration or instituting any other proceeding on such claim to allow TO to investigate and respond.
